Cassetto Terms of Service
Welcome to Cassetto. These Terms of Service (the “Terms”) are a binding agreement between you and Cassetto LLC (“Cassetto,” “we,” “us,” or “our”). They govern your use of the Cassetto mobile applications, our websites at cassettosocial.com, cassetto.social, and cassetto.link, and any related features and services we offer (collectively, the “Service”). Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
IMPORTANT: These Terms include important provisions regarding limitations of our liability (Section 12), indemnification (Section 13), and the law and venue that apply to disputes (Section 15). Please review them carefully.
1. Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that (a) you are at least 18 years old; (b) you have the legal capacity to enter into these Terms; and (c) your use of the Service complies with all applicable laws.
You may not use the Service if you have been previously suspended or removed by Cassetto, or if you are prohibited from receiving services under the laws of the United States or any other applicable jurisdiction.
2. Your Account
To use most features of the Service, you must create an account. We use your phone number as your account identifier and authenticate you by sending a one-time passcode (OTP) by SMS when you sign in to a new device or session. You typically remain signed in on a device until you sign out or your session expires. We do not use passwords.
When you create and use an account, you agree to:
- Provide a phone number that belongs to you and that you control, and keep it up to date in your account settings.
- Keep your phone and SIM secure, and never share one-time passcodes with anyone (Cassetto employees will never ask you for your code).
- Be responsible for all activity that occurs under your account.
- Notify us promptly at legal@cassettosocial.com if you suspect unauthorized access to your account, or if you lose access to your phone number.
If your phone number changes or is reassigned by your carrier, you are responsible for updating it in the Service so a new owner of the number cannot access your account. You may not impersonate any person, misrepresent your affiliation, or use someone else’s account without permission. We reserve the right to reclaim usernames at our discretion, including for trademark protection or impersonation reasons.
By providing your phone number, you consent to receive SMS messages from us related to authentication (one-time passcodes), security alerts, and important account or service notices. Standard message and data rates from your carrier may apply.
You acknowledge that phone numbers may be reassigned by carriers, and that failure to maintain accurate account information may result in unauthorized access to your account. Cassetto is not responsible for losses arising from such reassignment where you have not updated your account information.
2.1 Use of Personal Data
Our collection, use, and sharing of personal data is described in our Privacy Policy. This includes how we use your phone number for authentication, security, and service-related communications. By using the Service, you acknowledge and agree to these practices.
3. The Service
Cassetto is a music-sharing service that allows you to post songs you have been listening to and discover new music through recommendations from other users. Songs on Cassetto are linked from third-party streaming services (such as Spotify, Apple Music, and YouTube). We retrieve and display publicly available metadata (such as song title, artist, album name, and album art) from those services so you can post and view songs.
Cassetto does not host, store, or stream music content. All music playback occurs on third-party services, and your interaction with such content is governed by the terms of those services.
We may add, modify, or discontinue features of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
4. User Content
4.1 What You Post
“User Content” means any content you submit, post, share, or otherwise make available through the Service, including, but not limited to, songs posted, captions, comments, profile information, lists, and feedback. You retain ownership of any intellectual property rights you hold in your User Content.
4.2 License You Grant to Cassetto
By submitting User Content to the Service, you grant Cassetto a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for technical purposes such as resizing or formatting), publicly display, publicly perform, distribute, and otherwise use your User Content solely for the purpose of operating, providing, improving, promoting, and developing the Service. This license continues even after you stop using the Service for content that has been shared with others or used in aggregated or de-identified form, but otherwise terminates within a reasonable period after you delete your User Content or your account.
4.3 Your Responsibility
You are solely responsible for your User Content and for the consequences of posting it. You represent and warrant that:
- You own or have the necessary rights, licenses, consents, and permissions to post your User Content and to grant the license above.
- Your User Content does not and will not infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights.
- Your User Content complies with these Terms and all applicable laws.
4.4 Our Right to Remove Content
We do not pre-screen User Content, but we may review, remove, edit, restrict, or refuse to display any User Content at any time, for any reason, including to enforce these Terms or our community standards, comply with legal obligations, or protect the safety and integrity of the Service and our users.
We may use automated systems and human review to detect and address violations. We are not obligated to host or display any User Content.
5. Acceptable Use
You agree not to use the Service to:
- Post content that is unlawful, infringing, defamatory, fraudulent, obscene, sexually explicit (including content sexualizing minors), harassing, threatening, hateful, or that incites violence.
- Harass, bully, stalk, intimidate, or threaten any person.
- Impersonate any person or entity or misrepresent your affiliation.
- Post or transmit spam, chain letters, pyramid schemes, or unsolicited advertising.
- Upload viruses, malware, or other harmful code, or interfere with the Service’s operation.
- Attempt to gain unauthorized access to any account, system, or network, including by SIM swapping, phishing for one-time passcodes, or otherwise circumventing our authentication.
- Use any automated means (bots, scrapers, crawlers) to access, scrape, or collect data from the Service, except in accordance with a publicly available robots.txt file or with our prior written consent.
- Reverse engineer, decompile, or disassemble any part of the Service, except as expressly permitted by applicable law.
- Use the Service to develop a competing product or service.
- Violate any applicable law or regulation, or any third party’s rights.
- Encourage or enable any of the foregoing.
- Use the Service in a manner that could overburden, disrupt, or negatively impact the integrity, performance, or availability of the Service.
6. Cassetto Intellectual Property
The Service, including its software, design, text, graphics, logos, and the Cassetto name and brand, is owned by Cassetto or our licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. No other rights are granted to you, expressly or by implication.
7. Third-Party Content and Services
Cassetto displays metadata and album art retrieved from third-party streaming services (such as Spotify, Apple Music, and YouTube), and links to content hosted by those services. All such third-party content is owned by its respective rights holders, and your use of it is subject to the terms and conditions of the third-party service that hosts it. Cassetto does not own this content and makes no representations or warranties regarding it. We are not responsible for any third-party content, websites, or services, or for the actions of any third parties.
When you click a link to a third-party service, you leave the Service and your activity on that third-party service is governed by that service’s terms and privacy policy. You are responsible for complying with the terms of any third-party service you use in connection with Cassetto.
We may rely on application programming interfaces (APIs) and other integrations provided by third-party services. Your use of features that interact with such services must comply with their applicable terms. Cassetto is not responsible for any changes, limitations, or restrictions imposed by third-party providers.
7.1 Future Features and Monetization
We may, now or in the future, offer paid features, subscriptions, advertisements, or other monetization mechanisms as part of the Service. We reserve the right to modify, introduce, or discontinue such features at any time, with or without notice, subject to applicable law.
8. Copyright and DMCA Policy
Cassetto respects the intellectual property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
8.1 Reporting Infringement
If you believe that material on the Service infringes your copyright, please send a written notice to our designated DMCA agent that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it on the Service (such as a URL).
- Your contact information, including address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

8.3 Counter-Notice
If you believe that your User Content was removed or disabled in error, you may submit a counter-notice that complies with 17 U.S.C. § 512(g) to dmca@cassettosocial.com.
8.4 Repeat Infringers
We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
9. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, if your use poses a risk or harm to Cassetto, our users, or third parties, or for any other reason at our discretion. Upon termination, your right to use the Service ends immediately, and we may delete or retain your User Content as described in our Privacy Policy. We may also suspend or terminate accounts that are inactive for an extended period of time, or to maintain the integrity of the Service, including in cases of suspected impersonation, fraud, or misuse.
Sections that by their nature should survive termination will survive, including ownership provisions, license grants you have given us, disclaimers, indemnification, limitations of liability, and dispute resolution provisions.
10. Feedback
If you provide us with suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, modify, and incorporate that feedback into the Service or our other products and services without any obligation to you.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, CASSETTO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; THAT SMS DELIVERY WILL BE TIMELY OR RELIABLE; OR THAT ANY USER CONTENT OR INFORMATION YOU OBTAIN THROUGH THE SERVICE IS ACCURATE, RELIABLE, OR COMPLETE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CASSETTO, ITS AFFILIATES, OR ITS OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, CASSETTO’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU HAVE PAID CASSETTO, IF ANY, IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless Cassetto and its affiliates, and its and their officers, directors, employees, and agents, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right. We reserve the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the “Last Updated” date above, and where appropriate, by sending you an in-app notice or SMS. Material changes will become effective no sooner than 14 days after we provide notice. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules, and applicable U.S. federal law.
15.2 Venue
Subject to Section 15.3, you and Cassetto agree that any dispute arising out of or related to these Terms or the Service must be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you and Cassetto consent to personal jurisdiction in those courts.
15.3 Informal Resolution
Before filing any claim, you agree to try to resolve the dispute informally by contacting us at legal@cassettosocial.com. We will try to resolve the dispute by contacting you. If a dispute is not resolved within 60 days of submission, you or Cassetto may bring a formal proceeding.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced in them, constitute the entire agreement between you and Cassetto regarding the Service and supersede any prior agreements between you and Cassetto regarding the same subject matter.
16.2 Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
16.3 No Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision. Any waiver must be in writing and signed by an authorized representative of Cassetto.
16.4 Assignment
You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms without restriction. Any unauthorized assignment is void.
16.5 No Agency
No agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship is created by these Terms.
16.6 Notices
We may provide notices to you by SMS to your registered phone number, by in-app notification, by posting on the Service, or by other reasonable means. You may provide notices to us at legal@cassettosocial.com or at the address below.
You consent to receive electronic communications from us, and agree that all notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.
16.7 Apple-Specific Terms
If you access the Service through an iOS application, you acknowledge that these Terms are between you and Cassetto only, not with Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide any maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16.8 Google Play-Specific Terms
If you access the Service through an Android application obtained from Google Play, your use is also governed by the Google Play Terms of Service. You acknowledge that Google has no responsibility for the Service.
